This email is a reminder to all about the agreement between CUNY and the PSC regarding the granting of compensatory time for employees in the HEO series, represented by the PSC, who are assigned to work hours beyond the contractual 35 hour week.
The terms of the agreement are as follows:
- HEO Series employees represented by the PSC who are non-exempt under the Fair Labor Standards Act (FLSA) and who are assigned by their supervisor to work more than 35 hours in the workweek shall receive:
- compensatory time, on an hour-for-hour basis, for hours assigned between 35 and 40; and
- payment, instead of compensatory time, at the rate of time and one-half for any hours worked in excess of 40 hours in awork week.
- HEO Series employees represented by the PSC who are exempt under the FLSA and who are assigned by their supervisor to work more than 35 hours in the workweek shall receive compensatory time, on an hour-for-hour basis, for hours assigned by their supervisor in excess of 35 hours in a week.
- Assigned hours beyond the 35-hour work week must be authorized in advance and in writing by the appropriate administrator. In cases of emergencies, where it is not practical to provide such written authorization in advance, such authorization shall be put in writing as soon thereafter as practicable.
- A separate weekly timesheet for reporting overtime and compensatory time earned must be completed by the employee and signed by the supervisor and the appropriate authorized administrator (see online timesheet). Once all signatures have been obtained, the timesheet should be submitted to Human Resources.
- Compensatory time should be used as promptly as possible within the quarter in which it is earned but no later than 30 calendar days after the end of said quarter.
- The use of compensatory time shall be scheduled by the supervisor, in consultation with the employee. The employee should indicate on their monthly timesheet when comp time was used.
- HR will track and, on a quarterly basis, notify all HEO series employees covered by this agreement of their accumulation and usage of comp time via email (sample email online). If a HEO series employee, covered by this agreement, has not accrued or used comp time within a given quarter, they will be informed of those facts.
- The contractual HEO “leave year” is Sept. 1 – Aug. 31; therefore, the quarters are designed as Sept. – Nov., Dec.r – Feb., Mar. – May, June – Aug.
**Please be advised that under no circumstances should employees or departments have their own agreements, rules, policies, or procedures with respect to assigning, accruing, using, or recording HEO compensatory time. All must abide by the terms of the PSC/CUNY agreement as detailed above.**
